{"id":10613,"date":"2020-05-01T16:11:28","date_gmt":"2020-05-01T06:11:28","guid":{"rendered":"https:\/\/ppmmagazine.com.au\/?p=10613"},"modified":"2022-11-08T17:57:56","modified_gmt":"2022-11-08T07:57:56","slug":"two-examples-of-real-life-insurance-claims","status":"publish","type":"post","link":"https:\/\/professionalpestmanager.com\/nz\/running-a-pest-control-business\/insurance\/two-examples-of-real-life-insurance-claims\/","title":{"rendered":"TWO EXAMPLES OF REAL-LIFE INSURANCE CLAIMS"},"content":{"rendered":"<p><em><strong>Jackie Bougatsas<\/strong> from Wallace Risk Insurance shares two examples of typical claims made against pest managers, with recommendations on how to avoid these kinds of situations.<\/em><br \/>\n<!--more--><\/p>\n<div class=\"hr-thick\"><\/div>\n<p>Wallace Risk Solutions was due to host the inaugural Talking Inspections seminar on March 20, 2020, however, due to COVID-19 it was postponed.<\/p>\n<p>Part of the day was devoted to claims \u2013 sharing information with pest managers about the typical kinds of claims we see here at Wallace Risk Solutions, the reasons behind them, and what we are doing as an insurer to help reduce the frequency of them. It was planned to be an educational session where pest inspectors would be able learn how to avoid common pitfalls of the job, ones that have potentially serious consequences.<\/p>\n<p>We thought we would share two of the real-life case studies we had prepared for the day with you here.<\/p>\n<table style=\"height: 825px;\" width=\"773\">\n<colgroup>\n<col \/>\n<col \/><\/colgroup>\n<tbody>\n<tr>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Allegation 1:<\/p>\n<\/div>\n<\/div>\n<\/td>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Claimant alleges termite damage was present and not noted by the pest inspector and failed to note a significant termite infestation at the time of inspection.<\/p>\n<\/div>\n<\/div>\n<\/td>\n<\/tr>\n<tr>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Amount Originally Claimed:<\/p>\n<\/div>\n<\/div>\n<\/td>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>$70,000<\/p>\n<\/div>\n<\/div>\n<\/td>\n<\/tr>\n<tr>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Final Amount Settled:<\/p>\n<\/div>\n<\/div>\n<\/td>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>$170,000 \u2013 (actual costs of repair)<\/p>\n<\/div>\n<\/div>\n<\/td>\n<\/tr>\n<tr>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Third Party Cost i.e. Lawyers\/ Experts:<\/p>\n<\/div>\n<\/div>\n<\/td>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>$50,000<\/p>\n<\/div>\n<\/div>\n<\/td>\n<\/tr>\n<tr>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Recommendation:<\/p>\n<\/div>\n<\/div>\n<\/td>\n<td>\u2022 Initially the pest inspector\u2019s prospects of defence were good on the basis of:<\/p>\n<p>1) The claimants did not follow the inspector\u2019s recommendation to treat the property to prevent termites from infesting;<\/p>\n<p>2) From the outset, claimants had not had the damage assessed (instead only requested details of the inspector\u2019s insurer so that rectification works could be carried out).<\/p>\n<p>\u2022 Once expert opinion was sought, the pest inspector\u2019s prospects of success declined significantly on the basis of:<\/p>\n<p>1) Expert opined the termites would have been in the house for approximately a year at time of the inspector\u2019s inspection;<\/p>\n<p>2) The pest inspector did not comply with requirements for \u2018tapping\u2019 or \u2018sounding\u2019 the walls and timbers.<\/td>\n<\/tr>\n<tr>\n<td>Lessons:<\/td>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>\u2022 Avoid statements being put in reports i.e. \u2018the subject property is structurally sound\u2019.<\/p>\n<p>Such a definitive statement cannot normally be made as only about half the property is visible to make such a determination. Many parts of the structure including foundations, footings, wall framing and other structural elements are often concealed, obstructed or not readily accessible at the time of inspection.<\/p>\n<p>Any definitive statement that cannot be substantiated must be avoided as it makes it extremely difficult to defend in the event of a claim.<\/p>\n<p>\u2022 All communication about the treatment of the dwelling should be in writing.<\/p>\n<\/div>\n<\/div>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<table style=\"height: 825px;\" width=\"773\">\n<colgroup>\n<col \/>\n<col \/><\/colgroup>\n<tbody>\n<tr>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Allegation 2:<\/p>\n<\/div>\n<\/div>\n<\/td>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Claimant alleged the pest manager\u2019s internal spray left noticeable run-off streaks to numerous walls inside the property, affecting paintwork.<\/p>\n<\/div>\n<\/div>\n<\/td>\n<\/tr>\n<tr>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Amount Claimed:<\/p>\n<\/div>\n<\/div>\n<\/td>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>None demanded<\/p>\n<\/div>\n<\/div>\n<\/td>\n<\/tr>\n<tr>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Final Amount Settled:<\/p>\n<\/div>\n<\/div>\n<\/td>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>$4000 \u2013 amount offered<\/p>\n<\/div>\n<\/div>\n<\/td>\n<\/tr>\n<tr>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Third Party Cost i.e. Lawyers\/ Experts:<\/p>\n<\/div>\n<\/div>\n<\/td>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>$0<\/p>\n<\/div>\n<\/div>\n<\/td>\n<\/tr>\n<tr>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Recommendation:<\/p>\n<\/div>\n<\/div>\n<\/td>\n<td>\u2022 On balance, the pest manager\u2019s liability was difficult to dispute but before the insurer agreed to settle, the insurer recommended that the pest manager give consideration to the following:<\/p>\n<p>1) Whether the problem had been caused by the pest manager\u2019s application of the product, or was it a common problem with the product generally?<\/p>\n<p>2) Had a quote has been obtained to fix the problem?<\/p>\n<p>3) Whether the pest manager had agreed that the walls had been damaged by the spray (i.e. caused by streaks)?<\/p>\n<p>4) Was this an uncommon event in the pest manager\u2019s experience?<\/p>\n<p>5) The pest manager\u2019s knowledge on how\/why it may have occurred in this particular instance?<\/td>\n<\/tr>\n<tr>\n<td>Lessons:<\/td>\n<td>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>\u2022 Possible prevention tips:<\/p>\n<p>1) Ensure chemical is mixed correctly to the manufacturer\u2019s recommendation;<\/p>\n<p>2) Avoid excessive spraying to walls;<\/p>\n<p>3) Ensure backpack sprayer does not contain residue from the application of other chemicals.<\/p>\n<\/div>\n<\/div>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>In the above-mentioned cases the insurer paid the agreed amounts to the claimants and also paid the third-party costs (lawyers and experts).<\/p>\n<p>So how did these outcomes affect the pest managers\u2019 premiums? In the first case study, the insured was offered renewal terms with an increased premium and excess. In the second case study the insured was offered renewal with no change to premium or excess.
